Rakuten Sales Channel ("the App”) provides product listing and order management for the Rakuten Ichiba marketplace to merchants who use Shopify to power their stores ("the Service"). This Privacy Policy describes how personal information is collected, used, shared, etc. when you install and use the App.

Personal Information the App Collects

We (Byward Labs) collect the following personal information about you (in this policy, “you” refers to the merchants as sellers who use the App) and your customers through the App:

  • Product information

  • Order information

  • Inventory information

  • Store locales

  • Information regarding your Rakuten/RMS account

  • Information about you and others who may access the App on behalf of your store, such as your name, address, email address, phone number, and billing information

  • Purchase information of your customers

We collect personal information directly from the relevant individual, through your Shopify account, or using the following technologies:

  • “Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps. 

  • “Web beacons,” “tags,” and “pixels” are electronic files used to record information about how you browse the Site.


How Do We Use Your Personal Information?

  • We use the personal information we collect from you and your customers in order to provide the Service and to operate the App. We will not use personal information about your customers other than this purpose.

  • Additionally, we also use personal information about you to: Communicate with you; Optimize or improve the App; and Provide you with information or advertising relating to our products or services. 

Sharing Your Personal Information

  • We provide Rakuten, Inc. (“Rakuten”) located in Japan with information about you, including the URL of your store on the Shopify platform, store name, store address, store contact person’s name, email address and phone number. This information will be collected and used by Rakuten in order for Rakuten to provide information to you about opening a store on Rakuten Ichiba.   • We may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. Your Rights 

Data subjects (you and your customers) have the right to:

  • access personal information we hold about them
  • ask that their personal information be corrected, deleted, or restricted to use
  • claim an objection to its use
  • receive their personal information in an usable electronic format and transmit it to external parties (data portability)
  • and ask for more information about the handling of personal information

Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.

Also, Residents living in California (United States of America) can suspend the provision of Personal Information to third parties that is defined as “sales” by California State law (you can exercise this right from the following link: “Do Not Sell My Personal Information”).

Finally, data subjects also have the right to make a complaint to data protection authorities in each country where they reside.

Data Retention

When an order is placed through the Site, we will maintain personal information about you and your customers for our records, which is limited to the purpose of providing the Service and operating the App.

Changes

We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.
